TELEMEDIX PRIVACY POLICY 

When visitors leave comments on this site we collect the data shown in the comments form, and also the visitor’s IP address and browser user agent string to help spam detection.

An anonymized string created from your email address (also called a hash) may be provided to the Gravatar service to see if you are using it. 

Media

 If you upload images to the website, you should avoid uploading images with embedded location data (EXIF GPS) included. Visitors to the website can download and extract any location data from images on the website.

Cookies

If you leave a comment on our site you may opt-in to saving your name, email address and website in cookies. These are for your convenience so that you do not have to fill in your details again when you leave another comment. These cookies will last for one year.

If you visit our login page, we will set a temporary cookie to determine if your browser accepts cookies. This cookie contains no personal data and is discarded when you close your browser.

When you log in, we will also set up several cookies to save your login information and your screen display choices. Login cookies last for two days, and screen options cookies last for a year. If you select “Remember Me”, your login will persist for two weeks. If you log out of your account, the login cookies will be removed.

If you edit or publish an article, an additional cookie will be saved in your browser. This cookie includes no personal data and simply indicates the post ID of the article you just edited. It expires after 1 day.

Embedded content from other websites

Articles on this site may include embedded content (e.g. videos, images, articles, etc.). Embedded content from other websites behaves in the exact same way as if the visitor has visited the other website.

These websites may collect data about you, use cookies, embed additional third-party tracking, and monitor your interaction with that embedded content, including tracking your interaction with the embedded content if you have an account and are logged in to that website.

Who we share your data with

 If you request a password reset, your IP address will be included in the reset email.

How long we retain your data

 If you leave a comment, the comment and its metadata are retained indefinitely. This is so we can recognize and approve any follow-up comments automatically instead of holding them in a moderation queue.

For users that register on our website (if any), we also store the personal information they provide in their user profile. All users can see, edit, or delete their personal information at any time (except they cannot change their username). Website administrators can also see and edit that information.

What rights you have over your data

If you have an account on this site, or have left comments, you can request to receive an exported file of the personal data we hold about you, including any data you have provided to us. You can also request that we erase any personal data we hold about you. This does not include any data we are obliged to keep for administrative, legal, or security purposes.

The parties to this Privacy Policy and Terms of Agreement hereby agree as follows:

1. Definitions

HIPAA Laws: Refers collectively to the Health Insurance Portability and Accountability Act (HIPAA), and the Health Information Technology for Economic and Clinical Health (HITECH) Act, including all regulations under 45 C.F.R. Parts 160 and 164, as modified, supplemented, and amended.

PHI: Protected Health Information as defined in 45 C.F.R. § 160.103, limited to PHI received by TeleMEDix from or created, received, maintained, or transmitted by TeleMEDix on behalf of users’ and it’s contractors through users use of the Services.

Security Measures: The administrative, physical, and technical safeguards required under the HIPAA and GDPR Security Rules.

Services: The AI scribe and AI Health Coach services provided by TeleMEDix to users, whereby TeleMEDix processes PHI on behalf of the user of corporate client.

2. Permitted Uses and Disclosures of PHI

2.1 Performance of the Agreement for TeleMEDix Services

TeleMEDix shall not use or disclose PHI other than as permitted or required by this Privacy Policy and Terms of Agreement or as Required by Law.

2.2 Management, Administration, and Legal Responsibilities

TeleMEDix may use and disclose PHI for proper management and administration or to carry out legal responsibilities, provided disclosure occurs only if required by law or if TeleMEDix obtains reasonable assurances of confidentiality from the recipient.

3. Responsibilities with Respect to PHI

3.1 TeleMEDix’s Responsibilities

a. Limitations on Use, Disclosure, and Sale: TeleMEDix shall only use the minimum necessary PHI for proper business purposes and shall not sell PHI.

b. Safeguards: TeleMEDix shall implement appropriate safeguards to prevent improper use or disclosure of PHI.

c. Subcontractors: TeleMEDix shall ensure its subcontractors agree in writing to the same or more stringent restrictions on PHI.

d. Reporting to Company: TeleMEDix shall report to it’s subcontractords any unauthorized use, disclosure, or security incidents concerning PHI.

e. Unsuccessful Security Incidents: TeleMEDix is not required to report unsuccessful security incidents unless they result in unauthorized access.

5. Post-Termination Obligations

5.1 Return, Destruction, or Retention of PHI Upon Termination

Upon termination of services TeleMEDix shall return or destroy all PHI received from  the user. If return or destruction is infeasible, TeleMEDix will continue to protect such PHI.

6. Limitation of Liability

TeleMEDix’s total and aggregate liability to customer for all damages arising out of or in connection with a breach of this agreement caused by TeleMEDix will not exceed ten thousand dollars. This limitation applies to all causes of action in the aggregate, including, without limitation, breach of contract, misrepresentations, negligence, strict liability and other torts. These limitations apply notwithstanding any failure of essential purpose of any remedy.

All legal notices under this Agreement shall be delivered via electronic mail to the specified addresses for both TeleMEDix and Company.

7. Governing Law: This Agreement is governed by the laws of the State of California.
